These Terms of Service (“Terms”) govern access to and use of our website(s), mobile experiences, and services (collectively, the “Services”), including purchases of products and digital content. By using the Services, you agree to these Terms and to our Privacy Policy and Return & Refund Policy, which are incorporated by reference.

1. Eligibility & Accounts

  • Eligibility. You must be at least 13 (U.S.) or 16 (EU/UK) years old, or have parental consent if required by local law. By using the Services, you represent that you meet the applicable age and legal capacity requirements.

  • Account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may refuse, suspend, or close accounts at our discretion, consistent with applicable law.

2. Orders, Pricing & Payment

  • Offer & Acceptance. Placing an order is an offer to buy. We may accept or reject any order (e.g., due to suspected fraud, inventory limits, pricing or product information errors). If we cancel after payment, we’ll promptly refund you.

  • Pricing & Taxes. Prices may change without notice. Applicable taxes, duties, and import fees are added at checkout or assessed upon delivery, as required by law and destination.

  • Payment. We accept the payment methods shown at checkout. By submitting a payment, you authorize the transaction and represent that you are authorized to use the method. Payments are processed by third-party processors in accordance with PCI-DSS.

  • Promotions. Coupons, credits, and promotional codes are subject to terms stated at issuance and may be limited, non-transferable, and single-use.

3. Shipping, Delivery & Risk of Loss

  • Shipping. We ship to the countries indicated at checkout. Estimated delivery times are provided for convenience and are not guaranteed unless expressly stated.

  • Risk of Loss; Title. For physical goods, title and risk of loss pass to you upon delivery to the delivery address (or to the carrier where applicable by law).

  • Customs. International shipments may be subject to inspections, duties, or fees beyond our control.

4. Returns, Exchanges & Refunds

Your purchase is subject to our Return & Refund Policy.

  • EU/UK: Consumers have a 14-day right of withdrawal for most distance purchases; we reimburse the product price and standard outbound shipping in accordance with the law.

  • U.S.: We accept returns per our posted policy and applicable consumer laws.
    Certain items (e.g., personalized goods, perishable items, opened hygienic products, or downloaded/activated digital content) may be non-returnable, except where legally required.

5. Subscriptions & Auto-Renewals (if offered)

  • Term & Renewal. Subscriptions auto-renew for successive periods unless cancelled before the renewal date, at the then-current rates.

  • Cancellation. Cancel at any time via Account → Subscriptions or by contacting getzyric@gmail.com. Access remains until the end of the paid period; partial periods are generally non-refundable unless required by law.

  • Trials. If a free trial is offered, we’ll specify its length at sign-up. After the trial, the subscription converts to a paid plan unless you cancel beforehand.

6. Digital Content & Software Licenses (if applicable)

  • License. Subject to these Terms and payment, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use purchased digital content for personal, non-commercial use.

  • Restrictions. No copying, modifying, reverse-engineering, reselling, or circumventing DRM/technical protections, except to the extent permitted by mandatory law.

  • Withdrawal (EU/UK). The 14-day withdrawal right for digital content may not apply after download/streaming begins with your prior consent and acknowledgment that you lose this right, as allowed by law.

7. User Content & Acceptable Use

  • Your Content. If you submit reviews, images, comments, or other content (“User Content”), you grant us a worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, publish, and display that content in connection with the Services and our marketing, in compliance with privacy laws. You represent that you own or control all rights to your User Content.

  • Prohibited Conduct. You agree not to:

    • use the Services for unlawful, deceptive, or fraudulent purposes;

    • infringe others’ intellectual property or privacy;

    • upload malware or interfere with security or operation of the Services;

    • scrape, crawl, or harvest data except as permitted by robots.txt;

    • misrepresent your identity or affiliation;

    • circumvent access controls, quotas, or rate limits.

8. Intellectual Property

All content on the Services—including text, graphics, logos, product images, videos, software, and trademarks—is owned by us or our licensors and is protected by intellectual property laws. Except as expressly allowed, no rights are granted to you by implication or otherwise.

9. Third-Party Services & Links

The Services may link to or integrate third-party websites, apps, or services. We are not responsible for third-party content or practices. Your use of third-party services is governed by their terms and privacy policies.

10. Privacy

Our Privacy Policy explains how we collect, use, and share personal data and describes your rights (including GDPR and CCPA/CPRA rights, where applicable). By using the Services, you acknowledge our data practices as described there.

11. Warranties; Disclaimers

  • General. To the maximum extent permitted by law, the Services and all products are provided “as is” and “as available.” We disclaim all warranties not expressly set out in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • Consumer Rights Preserved (EU/UK). Nothing in these Terms limits mandatory consumer rights, including legal guarantees regarding conformity of goods.

  • Information. Product descriptions, sizing, colors, and availability are provided in good faith but may vary due to display settings, materials, or manufacturing changes.

12. Limitation of Liability

  • Cap. To the maximum extent permitted by law, our aggregate liability for claims arising out of or relating to the Services or any products will not exceed the greater of: (a) the amount you paid for the product(s) giving rise to the claim, or (b) US$100.

  • Exclusions. We will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, loss of data, or business interruption.

  • Mandatory Exceptions (EU/UK). Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law. Your statutory rights remain unaffected.

13. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your User Content, or your misuse of the Services, to the extent permitted by law.

14. Dispute Resolution & Governing Law

  • Governing Law (non-exclusive).

    • U.S. residents: the laws of the State of [State], U.S.A., excluding conflict-of-laws rules.

    • EU/UK residents: these Terms are governed by your country of residence’s mandatory consumer laws; you may bring claims in your local courts.

  • European ODR. EU consumers may use the European Commission Online Dispute Resolution (ODR) platform where applicable; we are not obligated to participate in any specific ADR scheme unless required by law.

  • Informal Resolution. Before filing a claim, you agree to try to resolve the dispute by contacting getzyric@gmail.com.

14.1. Arbitration & Class-Action Waiver (U.S. only) — Optional Clause

Binding Arbitration. Except for small-claims court or injunctive relief for IP/security, any dispute will be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules.
Class Waiver. Disputes must be brought individually, not as a plaintiff or class member in any class or representative action.
Opt-Out. You may opt out within 30 days of first accepting these Terms by emailing getzyric@gmail.com with subject “Arbitration Opt-Out” and your account details.

15. Suspension & Termination

We may suspend or terminate your access to the Services (with reasonable notice where required by law) if you materially breach these Terms, engage in fraud, or use the Services in a way that creates risk or harm. You may stop using the Services at any time. Sections that by their nature should survive (e.g., IP, disclaimers, limitations, dispute resolution) survive termination.

16. Changes to the Services or Terms

We may modify the Services or these Terms from time to time (e.g., to reflect law changes or new features). If changes are material, we’ll provide reasonable notice (e.g., by email or in-product). Changes take effect on the posted “Last updated” date. Your continued use after the effective date constitutes acceptance. If you do not agree, you should stop using the Services and (if applicable) cancel subscriptions.

17. Communications; E-Sign Consent

You consent to receive electronic communications from us related to your account, orders, and the Services. We may provide disclosures and notices electronically. You can withdraw consent where permitted by contacting getzyric@gmail.com] (this may affect your ability to use certain features).

18. Country-Specific Terms (EU/UK vs. U.S.)

  • EU/UK Consumers. You benefit from mandatory consumer protections, including the 14-day withdrawal right for most distance sales, legal guarantees of conformity, and access to local dispute mechanisms. Nothing in these Terms affects these rights.

  • U.S. Consumers. Certain state laws provide specific rights (e.g., California, New York). Our disclaimers and limitations apply to the extent permitted by applicable state law.

20. Miscellaneous

  • Entire Agreement. These Terms, the Privacy Policy, and Return & Refund Policy are the entire agreement between you and us regarding the Services.

  • Severability. If any provision is found unenforceable, the remainder remains in effect.

  • Assignment. You may not assign these Terms without our prior written consent; we may assign as permitted by law.

  • No Waiver. Our failure to enforce a provision is not a waiver.

  • Force Majeure. We are not responsible for delays or failures due to events beyond our reasonable control (e.g., natural disasters, war, internet outages, government actions).
